The deal on the table
On 17 August, NSW Treasurer Daniel Mookhey, alongside Climate Change, Environment and Energy Minister Penny Sharpe, announced a fast track scheme for data centre approvals. Builders who meet a new set of environmental and efficiency guidelines get their planning applications assessed within 75 days, a significant cut from the standard process.
The trade-off is not free permission. To qualify, a builder has to sign power purchasing agreements with renewable energy providers, meet water use efficiency standards, fund the extra water and energy supply their project actually needs, invest in local infrastructure and future industries, and commit to skills training and job support in the community where they build. Miss the guidelines, and a project can simply be rejected.
Mookhey's own framing of the deal was blunt: "Data centres that want to build in New South Wales need to bring power, not take it." That is the entire policy in one sentence, speed in exchange for self sufficiency.
The protest that arrived a day early
Speed did not land as reassurance for everyone. The day before the scheme was announced, students and community organisers protested a data centre expansion in Western Sydney.
Community organiser Gokulan Gopal asked the two questions that will define this debate for the next several years: "Where is the water going to come from? Where is the power going to come from?" Sophie Shanaaz, from the "Stop the Slop" campaign, was more direct about the endpoint she wants: "We're really focused on getting all these AI data centres out of our suburbs."
Their scepticism is not really about the guidelines on paper. It is about whether "bring your own power and water" survives contact with a real construction timeline once a project is already approved and money is already spent. A 75 day approval clock is fast. Building a dedicated renewable power agreement and new water infrastructure alongside a data centre is not necessarily fast in the same way, and residents are the ones positioned to notice the gap if one government commitment moves quicker than the other.
The scale behind the argument
This is not a hypothetical debate over a handful of projects. NSW already has more than 60 data centres operating or under construction, with another 19 in the planning pipeline. That is a genuinely large buildout, already well underway before this announcement, and the fast track scheme is designed to accelerate a trend that was already running, not start a new one.
Read against the rest of Australia's AI infrastructure year, this is the same argument that has already played out in Tasmania, where Firmus's proposed data centres triggered a 4,200 signature petition and accusations over water sourcing, and the same set of questions South Australia's Royal Commission into AI has been explicitly tasked with examining, including data centre energy and water consumption. NSW is simply the largest and most populous state to now run directly into it.
Why "bring your own power" is a genuinely interesting policy answer
It is worth giving the NSW approach some credit before critiquing it further. A fast track scheme that requires builders to fund their own power and water, rather than drawing on the existing grid and existing supply that residents and other industries already rely on, is a more thoughtful design than simply waving projects through. It is a direct attempt to answer the exact question Tasmania's data centre fight keeps raising, who pays for the resources this industry actually consumes.
The open question is enforcement, not intent. A requirement on paper only matters if it survives the years between an approval and a building's first day of operation, through construction delays, cost overruns, and the temptation to lean on existing grid capacity if a dedicated renewable supply is not ready on schedule. That gap between commitment and delivery is exactly where Gopal's questions live, and it is a fair thing to stay sceptical about until there is a project that has actually gone through the full cycle.
What this means beyond NSW
Every state weighing its own version of this trade-off is watching how NSW's scheme performs in practice, because it is one of the more concrete policy answers so far to a problem that has mostly generated debate rather than design. If "bring your own power" works as intended in NSW, it becomes a template. If enforcement turns out to be weaker than the announcement suggested, that becomes the cautionary case other states point to instead.
Either way, the argument driving all of this, that AI infrastructure now competes directly with communities and other industries for finite land, water and power, is not going away. NSW just became the biggest state yet to try answering it with policy rather than just debate.
